These specific terms apply to the use of the blab2 (“Service Provider”)
free SMS service (“Messaging Service”) and are in addition to the general
Terms of Use defined elsewhere on this site.
By sending this message and or request, I hereby agree that I have read,
and agree to comply with the following terms and conditions governing this
Messaging Service. Your IP address, will be recorded for security purposes.
If fraudulent or illegal activity is recognized, all data will be submitted
to the appropriate authorities for further investigations. By submitting
a request on this IP address, you are agreeing "you are one in the
same" and are explicitly with implicit trust soliciting such a request
in good faith subject to the terms and conditions of this service.
1. This is an agreement between you and the Service Provider related to
your use of the Messaging Service. The agreement consists of the following
terms and conditions stated here there of. By your use of the Messaging
Service, you are deemed to have agreed to all of the terms of user.
2. We reserve the right, at our sole discretion, to change, modify or otherwise
alter these terms and conditions at any time. Such changes and/or modifications
shall become effective immediately upon the posting thereof. Without limiting
the foregoing, we may occasionally notify you by email or text about changes
to the Site or provide notices of changes by displaying notices or links
to notices to you generally on the Site. Please review the terms and conditions
periodically. Your continued use of the Site following the posting of changes

3. Use of Messaging Services: You are not to use the Messaging Service
for any unlawful or abusive purpose, including but not limited to any use
which disrupts customers, damages property, or interferes with the ability
to provide service to customers. You agree to comply with all laws while
using the Messaging Service and you agree not to transmit any communication
that would violate any laws, court order or regulation or would likely
be offensive to the recipient. You are responsible for all content you
transmit through the Messaging Service. Users must be a minimum of 16 years
of age or have parental permission to use this service.
4. Rules of Conduct: You agree that your use of the Messaging Service is
subject to all applicable laws and regulations and you are solely responsible
for all acts or omissions that occur during your use of the Messaging Service,
including, without limitation, the contents of your transmissions through
the Messaging Service. User agrees not to: Disseminate content intended
to harass, abuse, threaten, impersonate any other individual or entity,
disseminate obscene, defamatory, indecent, harmful, libellous, unlawful
and/or other objectionable material/information. Transmit or upload programs
or material that contains viruses, worms, trojan horses or other harmful
programs. Try to gain unauthorized access to the services, other users'
accounts, or computers connected to the Messaging Service though password
mining or other means. Violate any applicable laws or regulations.
5. Privacy: This service will not be liable for any lack of privacy you
may experience while using the Messaging Service.
6. Limitation of Liability: UNDER NO CIRCUMSTANCES WILL THE MESSAGING SERVICE
BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL,
SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER THAT ARISE
FROM YOU OR ANY USERS USE OF THE MESSAGING SERVICE. NO Warranties. THIS
SERVICE MAKES NO EXPRESS WARRANTY REGARDING THE MESSAGING SERVICE AND SPECIFICALLY
DISCLAIMS ANY IMPLIED WARRANTY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE.
7. Agreement: You acknowledge that these terms and conditions are a material
part of the decision to provide the Messaging Service to you.
8. Delivery of every message is not guaranteed. Service Provider will do
its best to deliver each requested message but cannot be held responsible
for issues beyond our control: network failures/delays, carrier failures/delays,
technical failures.
9. Fair Usage: Usage of this Messaging Service is limited by sender, by receipient, by day.

and may be changed without notice.
